Black Mountain police are investigating the death of a man who they say had been fighting with his son about possession of a dog prior to his death.

Police say officers were dispatched just after 2:30 a.m. to a reported disturbance along Fairway Drive on Saturday.

When officers arrived, they said they found Billy Ricketts Jr., 56, unresponsive in the street. Black Mountain police say Rickett's son, Billy Rickets III, 34, was already performing CPR when officers arrived.

Ricketts Jr. was taken to Mission Hospital, where he was pronounced dead.

Police say, after an investigation, they found there had been a physical altercation between the father and son over possession of a dog. They said the fight had started in the yard then spilled into the roadway.

"So, ultimately, assault did occur, and what we're doing is make sure we're aligning and get everything ready, so when the autopsy results come back, and we present to the district attorney,he has all the facts," Black Mountain Police Chief Shawn Freeman said.

The chief said the victim's adult son lived with his grandmother at the home where the fight took place.

An autopsy has been conducted, but Black Mountain police say the final cause of death has not been released by the State Medical Examiner.

The incident remains under investigation.
