Four East Henderson High students are charged with second degree rape of a classmate at the home of a Henderson County Sheriff deputy. James Matthew Bishop, Vincent Joseph Curto, Tyler Scott Garren, Justin Wesley Ponder have been arrested.
Arrest warrants say the victim was at the time mentally incapacitated and physically helpless.
Investigators say the alleged sexual attack happened December 8th at a party with alcohol hosted by the deputy's son. Because of where the attack happened, the Henderson County Sheriff's Office turned the investigation over to the SBI. Authorities found enough evidence to charge the deputies son, Tyler Garren and the three other students.
The parents of each boy charged were called to bring their child to the detention center. Their bonds were set at $30,000 each.
Bishop, Garren and Ponder were on this year's football team.
The sheriff's office wants to make it clear that Deputy Jason Garren had no involvement in this case. He and his wife were out of town at the time of the attack. Deputy Garren is not facing any disciplinary action.
