Missing Children Located, Charges Pending

Two young children at the center of a frantic search in Cherokee are safe and back with their mother Tuesday night. Police say their father, Kyle Smith, abducted them Monday.

The situation was finally resolved after a family member agreed to pick the children up, bring them to the police station and return them to their mother, Charmayne Chee.

15-month-old Liam and 4-month-old Kiera Smith had been gone for more than a day.  Police say the children were abducted after an argument over a protection order Chee just taken-out on Smith.

Police issued a BOLO stating the children were in grave or immediate danger. Police say they were in the process of filing a statewide Amber Alert, but backed-off when they learned Smith and his kids were still in the Cherokee area. 

Police have not charged the father tonight, but say they are continuing to investigate and charges are pending. However, police also say Kyle Smith has seven outstanding warrants, including six counts of assault on a female and one, second-degree child abuse. The outstanding warrants are not related to this abduction case.
