DWI Case Dropped
A judge dismisses the case against a woman accused of driving drunk with her child in the car.
News 13 first reported the DWI charges against Kimberly Uptergrove in February. Waynesville Police found her sitting in her car after she had backed into the McDonald's Restaurant on Russ Avenue. They found her 3-year-old child in the car with drugs hidden in the child's car seat.
The judge dismissed the case because prosecutors didn't have evidence for her trial. That's because the SBI crime lab had not completed analysis of the court-ordered blood sample.
The district attorney has asked the crime lab to expedite the analysis in this case. He says Uptergrove can be charged again once he receives the report.
