The Buncombe County Magistrate's Office says the wife of an Arden surgeon found shot to death will likely be jailed without bond because of the grand jury's indictment of her for first-degree murder.

Both the Buncombe County Magistrates Office and the clerk's office confirmed an "order" for Brenda McCutcheon's arrest was issued Wednesday morning.

The grand jury indictment registered in the clerk's office on Tuesday said McCutcheon lives in Brighton, Tennessee, which is a small town about 20 minutes northeast of Memphis. A source has previously told News 13 that Brenda McCutcheon has two sisters there, and moved to the area soon after authorities began investigating her for shooting her husband, Dr. Frank McCutcheon, in the head.

It is unclear if McCutcheon will turn herself in with her attorney or if authorities in Tennessee will take her into custody, or if local Buncombe sheriff's deputies will go arrest her. Brighton is over seven hours away from Asheville.

Sources have told News 13 that McCutcheon is represented by well-known defense attorney Sean Devereux, who often handles high-profile cases. Devereux has not returned News 13's calls for comment.
