EAST FLAT ROCK, N.C. (WLOS) — Site work is underway on property off Spartanburg Highway in East Flat Rock where an asphalt plant withdrew it's application to build several months ago.
"Since the asphalt plant is no longer happening in Hendersonville on Spartanburg Highway, what is now being built on that site?" a viewer wrote to Ask 13.

According to Henderson County Planning Department officials, a permit is not needed for grading or site work to be done on a piece of property.
The land off Spartanburg Highway still belongs to Jeff Shipman, whose conditional zoning permit was withdrawn in 2020 for the asphalt plant.
The county tells us it did approve a driveway permit. Officials said there has not been a request for any other land-use permit.

Officials said Shipman can submit his plans for the asphalt plant again. We're told the first time the county consider that application would be March 28, 2021.
According to the Henderson County Project Development Planner, "That consideration would begin with the technical review committee, then planning board, then ultimately a final decision on the application by the Board of Commissioners."
Efforts to get comments from Shipman about his intentions for the property have been unsuccessful.
